This Privacy Policy explains how MHM HOLDING LLC, doing business as TopMarker Agency (“TopMarker,” “we,” “us,” or “our”), collects, uses, and protects personal information when you visit www.topmarker.us, submit a form, or communicate with us by phone, SMS, or email.

TopMarker Agency is a digital marketing and advertising agency operated by MHM HOLDING LLC, a limited liability company registered in the United States. We help beauty salons and small businesses in the United States and Canada strengthen their online presence and attract new customers.

Information we collect

When you submit a form, we also record whether you checked the SMS consent box, the version of the consent language shown to you, and the date and time of your submission, so that we can honor your communication choices.

Our website hosting provider may automatically log basic technical information, such as IP address, browser type, and pages visited, to operate and secure the website.

How we use personal information

Phone calls and SMS communications

TopMarker may contact customers by phone or SMS for legitimate business communications consistent with the customer’s request and applicable consent requirements.

SMS communications may include customer support, consultation confirmations, appointment reminders, and service updates. Messages that are not replies to the customer’s own inquiries, such as appointment reminders and service updates, are limited to 4 per month per customer. Providing a phone number so that we can call you about a consultation does not by itself mean you agree to receive SMS messages. SMS consent is given separately, through an optional checkbox that is unchecked by default.

We do not send promotional or marketing SMS messages. Submitting a contact form alone is not consent to receive SMS messages.

You can opt out of SMS messages at any time by replying STOP. Reply HELP for assistance, or contact us at info@topmarker.us or (669) 666-6907. If you opt out, we will not resubscribe you automatically; you must actively give consent again, as described in our Terms & Conditions.

SMS privacy protection

SMS consent and phone numbers collected for SMS communication purposes will not be shared with third parties or affiliates for their marketing purposes.

Authorized service providers, such as our phone and messaging platform, email provider, and website hosting provider, may process personal information only as necessary to deliver communication services and operate our business on our behalf. These providers are not permitted to use your information for their own marketing purposes.

When we share information

We share personal information only:

  • With authorized service providers that help us operate our website, communicate with you, and deliver our services, as described above.
  • When required by law or legal process, or to protect our rights, our customers, or others.

Text messaging originator opt-in data and consent will not be shared with any third parties, excluding aggregators and providers of the Text Message services.

No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

Data retention

We retain personal information only as long as reasonably necessary for the purposes described in this Privacy Policy, including providing our services and keeping records of communication preferences, and to meet applicable legal obligations.

Children’s privacy

Our website and services are intended for business owners and are not directed to children under 13. We do not knowingly collect personal information from children.
